Someone with a legal UTV on the street registered in Montana might assume that Montana`s helmet laws are all they have to worry about. However, the fact is that helmet laws must be followed from state to state. That`s why you sometimes see motorcyclists stop and take off their helmets as soon as they enter a helmetless state. Montana`s helmet law doesn`t matter, except Montana, and the same goes for the state where your UTV is registered if you drive it elsewhere. Do you want to drive your SXS/VTT/UTV on the road? We can`t speak for every situation, but it often comes down to a lack of understanding of the traffic law process, coupled with the scarcity of road-approved UTVs in many parts of the country. Use only a road-approved UTV with a full and valid driver`s license. The long answer is a bit more complicated and falls into a gray area of UTV traffic laws in the United States.

In order to make the best choice here, we need to look at the situation through the eyes of local law enforcement agencies. You probably know that places like hiking trails, national parks, national forests, BLM lands, and PHEV areas generally require UTVs to have certain parts. What you may not know is that these places — we just call them all PHEV areas for brevity — almost always require you to have these parts, whether your UTV is legal or not. With that in mind, we`ve created a comprehensive list of parts that every legal UTV on the road should have based on their years of experience – find it here. As we explained in Part 3 of the manual, registering your UTV with a company is considered by many to be the best way to get a roadside approval. Not everyone chooses to register with a business, but just be aware that local property transfer laws may still apply if you don`t. It`s no secret that you`ll have more fun and attract more attention in a road-legal UTV than in almost any other vehicle. On the other side of the equation, none of the parts of your UTV that are homologated on the road should cause problems in PHEV areas, including DOT tires. If you`re driving in an area where UTVs can reach road legality, possibly through a city or county license, chances are a specific helmet law will be attached to that program. It could even be incorporated into the state`s motorcycle helmet law through a clause for vehicles with windshields or enclosed cabs.

Will local law enforcement enforce this law to your UTV even if you are not part of this specific program? Only a lawyer could answer this question with certainty, but it is quite understandable that both parties – the agent and the driver – could have thought they were on the right path. If that`s something you couldn`t or shouldn`t do in a Honda Civic, you shouldn`t do it in a legal UTV on the road either. Of course, this isn`t true if you`re off-road in places like public lands or ORV areas, but there are times when your road-certified UTV can still be considered an off-road vehicle, even in those places. According to some people, this 22 plug means you can drive your legal UTV down the road because nothing can be done. Some people have even gone so far as to explain the problem when they are arrested. From our perspective, if you find yourself in this situation, it`s best to contact a local attorney who has a thorough understanding of the vehicle laws in your state. In general, ATVs and side-by-sides are not allowed on California highways, including roads. Many public areas use road classifications in the U.S. Forest Service manual to determine which vehicles can use roads and paths. In our view, the Forest Service`s definition of «road-certified vehicle» includes any road-approved UTV vehicle registered in Montana or South Dakota, although it may not include UTVs otherwise registered by other states. PHEVs operating in Pennsylvania must carry liability insurance. If your UTV is legal on the street, you should already have sufficient insurance to meet this requirement (see Traffic Approval UTV Insurance). Roads can be crossed at an angle of approximately 90 degrees to the roadway after coming to a complete stop and yielding to traffic. Roads can also be used to cross a bridge or culvert. Shared highways can only be crossed at an intersection with another public road or highway. They may be stopped occasionally.
